DISTANCE SALES AGREEMENT

BUYER: The name, surname, address, telephone number, and email address of the person placing the order are as stated on the order form.
TOPIC 2
The subject of this Agreement is the sale and delivery of the product(s) ordered by the BUYER electronically from the SELLER's website www.indohometr.com , and the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
3. PRODUCT INFORMATION SUBJECT TO THE AGREEMENT
3.1. The type, quantity, model, color, number of units, sales price, payment method, and essential characteristics of the product subject to this contract are specified in the order form.
3.2. Product prices include VAT. Shipping costs are stated separately.
3.3. Due to the nature of handmade products, each item is unique. Natural characteristics such as wood grain, color tones, and texture may vary between products. These differences are not considered defects and do not constitute grounds for return/exchange.
3.4. Product photos on the website are for illustrative purposes only. Color and appearance may vary depending on monitor settings, lighting conditions, and shooting angles. These differences do not constitute grounds for return/exchange.
4. GENERAL PROVISIONS
4.1. The BUYER acknowledges and declares that they have read and are informed about the basic characteristics of the product, the sales price, the payment method, and preliminary information regarding delivery on the website www.indohometr.com , and that they have provided the necessary confirmation electronically.
4.2. The BUYER acknowledges that they have reviewed the product specifications, dimensions, and price before placing an order and that their purchase decision is based on this information.
4.3. The BUYER acknowledges that due to the bulky and heavy nature of furniture products, delivery times, shipping conditions, and return procedures may differ from those of standard e-commerce products.
4.4. The SELLER is responsible for delivering the product in good condition, complete, and conforming to the specifications stated in the order.
5. ORDER AND PAYMENT
5.1. The order is finalized when the BUYER completes the payment and the SELLER confirms the order.
5.2. The SELLER reserves the right to refuse or cancel any order without giving any reason. In this case, the amount paid by the BUYER will be refunded within 7 business days.
5.3. In cases such as price errors, stock shortages, or supply problems, the SELLER may cancel the order. In this case, the BUYER may only request a refund of the amount paid and may not claim additional compensation.
5.4. Installment payments for credit card transactions are subject to the agreement between the BUYER and the cardholder's bank.
5.5. For bank transfer/EFT payments, the order is confirmed on the date the payment is received in the SELLER's account. Orders for which payment is not received within 3 business days will be automatically cancelled.
6. DELIVERY
6.1. Delivery will be made to the address specified by the BUYER on the order form.
6.2. Delivery times are estimates and are not binding:
- In stock: 3-10 business days
- Made to order: 4-8 weeks
- Custom design orders: Timeframe specified in order confirmation.
6.3. The SELLER cannot be held responsible for delays caused by the following circumstances:
- Unexpected disruptions in the production process
- Raw material supply problems
- Customs procedures and import delays
- Delays caused by the shipping company.
- Force majeure events such as natural disasters, epidemics, and war.
- The buyer provides incorrect or incomplete address information.
6.4. In the event of a delivery delay, the BUYER may only cancel the order and request a refund of the amount paid. The BUYER cannot claim additional compensation or damages due to the delay.
6.5. If the BUYER is not present at the address when the shipping company attempts to deliver the product, the SELLER shall be deemed to have fulfilled its delivery obligation. In this case:
- Any additional charges arising from the product being held in the cargo warehouse are the responsibility of the BUYER.
- If the product is returned to the SELLER, the shipping cost will be charged to the BUYER.
6.6. The BUYER is obligated to inspect the product packaging in the presence of the delivery person upon delivery. If there is visible damage to the package, the BUYER must not accept the product without having a damage report drawn up. The SELLER will not accept damage claims for products received without a damage report.
6.7. Claims for damage or missing items not reported within 48 hours of delivery will not be considered.
7. RIGHT OF WITHDRAWAL
7.1. The BUYER may exercise the right of withdrawal within 14 (fourteen) days of delivery of the product subject to the contract.
7.2. To exercise the right of withdrawal, it is mandatory to notify the SELLER in writing via e-mail ( info@indohometr.com ) within 14 days.
7.3. The cancellation notice must clearly state the order number, product information, and reason for cancellation. Incomplete notices will not be processed.
8. SITUATIONS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
According to Article 15 of the Regulation on Distance Contracts and the nature of the transaction, the right of withdrawal CANNOT be exercised in the following cases:
8.1. Products prepared according to the BUYER's requests or explicitly personal needs (custom-ordered furniture, custom-sized products, personalized products)
8.2. All made-to-order products - including furniture imported from Indonesia on order - fall under this category.
8.3. Products that have been assembled or installed
8.4. Products that have been opened, used, or tested.
8.5. Products damaged due to reasons caused by the BUYER.
8.6. Products missing original packaging, labels, or accessories.
8.7. Products purchased at a discount, during a campaign, or as "final sale" items.
9. RETURN CONDITIONS IN CASE OF EXERCISING THE RIGHT OF WITHDRAWAL
9.1. Products to be returned under the right of withdrawal:
- It must be unused and untested.
- It must be in its original packaging, with all labels and accessories.
- There should be no damage, scratches, or stains.
9.2. Return shipping costs are the responsibility of the BUYER. The BUYER is responsible for securely packaging the product and sending it via insured shipping.
9.3. The SELLER is not responsible for damages occurring during the shipping process. Returns will not be accepted for products damaged due to inadequate packaging by the BUYER.
9.4. Returned products are inspected by the SELLER. If it is determined that the product does not meet the return conditions:
- The product is returned to the BUYER.
- Return shipping costs will be charged to the BUYER.
- No refund will be given.
9.5. A 15% restocking fee will be applied to returns of large furniture. This fee will be deducted from the refund amount.
9.6. In case of returns that meet the conditions, the product price will be refunded to the method used by the BUYER for payment within 14 business days after the product reaches the SELLER and is inspected.
10. DEFECTIVE PRODUCT
10.1. In the event of a claim that the product was delivered defective, the BUYER is obliged to notify the SELLER within 48 hours of delivery, documenting the situation with photographs.
10.2. The SELLER has the right to examine and evaluate the claim of defect. If necessary, it may request the return of the product or an independent expert report.
10.3. The following situations are NOT considered as defects/faults:
- Variations inherent in handmade products (wood grain, color tones, texture)
- Color changes that natural wood may exhibit over time.
- Color differences between product photos and the actual product.
- ±3% tolerance in measurements.
- Damage resulting from improper use, maintenance, or installation by the BUYER.
- Normal wear and tear
10.4. In the case of products deemed defective by the SELLER, the SELLER has the right to offer one of the following options: repair, exchange, or refund.
11. WARRANTY AND LIMITATIONS
11.1. INDOHOMETR handmade teak wood furniture is guaranteed against defects in materials and workmanship for 2 (two) years from the date of delivery.
11.2. Situations NOT covered by the warranty:
- Wear and tear from normal use.
- Damage resulting from misuse, neglect, or accident.
- Damage resulting from improper maintenance or cleaning methods.
- Avoid excessive humidity, direct sunlight, or exposure to heat sources.
- Products not specified as outdoor furniture should not be used outdoors.
- Repairs or modifications made by persons not authorized by the SELLER.
- Emergency situations such as natural disasters, fires, and floods.
11.3. In warranty claims, the SELLER reserves the right to apply whichever option it deems appropriate from among repair, parts replacement, or product replacement.
11.4. The warranty is not valid outside the country where the product was purchased.
12. LIMITATION OF LIABILITY
12.1. The SELLER's total liability under this agreement shall under no circumstances exceed the price paid by the BUYER for the product.
12.2. The SELLER shall not be held liable for any loss of profit, loss of business, loss of reputation, loss of data, or other indirect, incidental, special, or consequential damages.
12.3. In cases of force majeure (natural disaster, epidemic, war, strike, import/export restrictions, government intervention, etc.), the SELLER's obligations are suspended and the SELLER cannot be held responsible for such delays.
13. PRICE CHANGES AND CAMPAIGNS
13.1. Price reductions or promotions made after the order is completed do not apply to previous orders. The BUYER cannot request a price difference or refund on this ground.
13.2. Stock is limited for promotional items. The SELLER may terminate the promotion without prior notice when stocks run out.
14. INTELLECTUAL PROPERTY
14.1. All content (design, text, images, logos, product photos) on the www.indohometr.com website is the property of the SELLER.
14.2. The BUYER may not copy, reproduce, distribute, or use the site content for commercial purposes without the written permission of the SELLER.
15. PROTECTION OF PERSONAL DATA
15.1. The BUYER's personal data is processed within the scope of the Law No. 6698 on the Protection of Personal Data.

16. DISPUTE RESOLUTION
16.1. In case of disputes arising from this agreement, amicable settlement shall be sought first.
16.2. If a solution cannot be reached, the buyer shall apply to the Consumer Arbitration Board in their place of residence for disputes up to the value announced by the Ministry of Trade, and to the Ankara Consumer Courts for disputes exceeding this value.
16.3. For commercial purchases that do not fall under the definition of a consumer, the Courts and Enforcement Offices of Ankara have jurisdiction.
17. AMENDMENTS
17.1. The SELLER reserves the right to change the terms of this agreement without prior notice. Changes will take effect on the date they are published on the website.
17.2. The contract terms in effect on the order date are binding for that order.
18. EFFECTIVE DATE
18.1. By placing an order on the website www.indohometr.com , the BUYER declares that they have read, understood, and accepted all the terms of this agreement.
18.2. This agreement shall be deemed concluded and enter into force between the parties on the date the order is confirmed.
